Purpose & Scope
Welcome to Texas Gaming Innovation, LLC's ("Company," "we," "us," or "our") Terms of Service. These terms outline the contractual agreement between Texas Gaming Innovation, LLC and its users ("you," "your," or "user") governing your use of our services, including but not limited to commission orders, accounts, payments, and dispute resolution.
Accuracy of Information
You agree to provide accurate and up-to-date information when using our services. Any inaccurate or outdated information provided by you may result in the termination of your account or cancellation of orders.
Accounts and Membership
When you make purchases with us, a Microsoft account will be created for you to access your order information and products. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
You must be at least 16 years old to use our services. If you are under 16, you may only use our services under the supervision of a parent or legal guardian.
Billing and Payments
We accept payments through PayPal (Friends & Family) and CashApp. No other payment methods are accepted.
All commission orders require a 50% down payment upfront before work begins. The remaining 50% must be paid upon completion of the order.
No refunds will be issued for commission orders that are cancelled by the user after work has begun.
Refunds
Texas Gaming Innovation, LLC maintains a strict no-refund policy for all products and services listed on our website/store, as well as for any development services provided.
Digital Products & Services
Due to the digital nature of our products (including but not limited to EUP assets, vehicles, and livery designs), all sales are final once a purchase has been completed.
Texas Gaming Innovation, LLC does not have the ability to revoke or prevent continued use of digital products once they have been downloaded, and therefore refunds cannot be issued.
Commissioned Work
If you commission custom work from our EUP, Vehicle, or Livery departments, you may request a refund only if no files have been delivered to you.
Once any file of the commissioned work has been sent to you (whether complete or in-progress), your eligibility for a refund is automatically void.
Refund requests are subject to review, and Texas Gaming Innovation, LLC reserves the right to approve or deny such requests based on the status of the project at the time the request is received.
Chargebacks & Disputes
Customers agree not to initiate a chargeback or payment dispute without first contacting Texas Gaming Innovation, LLC to resolve the matter.
Unauthorized chargebacks or disputes will be considered a violation of these Terms of Service and may result in permanent suspension of access to our products, services, and future offerings.
Texas Gaming Innovation, LLC reserves the right to pursue legal action and recover any fees, damages, or costs incurred as a result of improper chargebacks.
Limitation of Liability
Texas Gaming Innovation LLC will not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our services.
We do not guarantee the accuracy, reliability, or completeness of any information, content, or materials provided through our services.
Dispute Resolution
Any disputes arising from or relating to your use of our services shall be resolved through our Executive Team. You can email them at executives@texasgaminginnovation.com.
Storage of Commission Orders
Commission orders will be stored on our servers for a period of 3 months from the date of completion. After this period, they will be deleted.
Termination
Texas Gaming Innovation, LLC reserves the right to terminate or suspend your account, access to our services, or any ongoing orders at our sole discretion, without prior notice, if you violate these Terms of Service.
Changes to Terms
We may modify or update these Terms of Service at any time. Continued use of our services after such changes constitutes your acceptance of the updated terms.
